From the suit:

"Joseph continues to suffer severe pain, mental anguish, humiliation, anxiety, and stress as a result of his time at Alldredge Academy. Id. at ¶ 141. On their own behalf on behalf of Joseph, the Giannones filed a Consolidated Amended Complaint against the Alldredge Defendants,1 the Greene Defendants,2 and fifteen John Does. The complaint includes twenty-three counts, including thirteen counts against the Alldredge Defendants and eleven counts against the Greene Defendants.3 The Giannones seek to recover from the Alldredge Defendants for violations of the Racketeer Influenced and Corrupt Organizations Act and for negligent child abuse, fraud, fraudulent misrepresentation, breach of fiduciary duty, breach of contract, assault, battery, negligence, negligent supervision, intentional infliction of emotional distress, negligent infliction of emotional distress, and civil conspiracy."  (Page  7)

Weston White, an Alldredge employee; Ron Schwenkler, Alldredge’s Director of Village; Ray Gwilliam, Alldredge’s Director of Extended Stay; Tom Harvey and Carrie Hawkins, two Alldredge Wilderness Field Supervisors; Sandra J. Schmiedeknecht, Alldredge’s Medical Director; Patrick O’Brien, Alldredge’s Village Program Director; and four other Alldredge employees whose last names are unknown but whose given names are Stan, Sarah, Travis, and Keith. 2 The "Greene Defendants" are Nancy V. Hassan A. Jafary Consulting Psychiatrist Earned Medical Degree in the Dominican Republic.  There are two Hassan A. Jafary's that hold medical licenses in WV.  one is Hassan Arshad Jafary and the other is Hassan Asghar Jafary.  Both licensed Jafarys reportedly work in Beckley, WV.  It is about an hour away from Pence Springs, where the program is located.  There is something fishy here.  Both Jafarys show that they are supervising Maryam Jafary Rana (a physician's assistant supposedly in Oregon).  The licensees appear to be the same person and this is acknowledged on some of the data available through the licensing board.  Hassan Asghar Jafary has been sued for malpractice, though no license board discipline has resulted.  Hassan Asghar Jafary claims to have been educated at:  Allama Iqbal Medical College, University Of The Punjab 09/30/1986 Medical or Podiatric School Ohio Valley Medical Center, Wheeling 6/30/1994 Post-Graduate Training and to be a general practitioner.  Hassan Arshad Jafary has no recorded malpractice suits on the licensing website.  And, Hassan Arshad Jafary appears to claim to specialize in psychiatry.   Hassan Arshad Jafary (license #: 23054) claims to have been educated at: School Of Medicine, Eugenio Maria De Hostos University 06/08/1989 Medical or Podiatric School Lincoln Md/Mh Ctr, Valhallia 6/30/2007 Post-Graduate Training.  Both Jafary licenses expire on 6/30/2018.  Hassan Asghar Jafary (license #: 18030) was originally licensed in 1995.  The lawsuit against him was in 2001.  Hassan Arshad Jafary was originally licensed in 2008.  Source: https://wvbom.wv.gov/public/search/details.asp  To file a complaint about either or both of these "doctors", visit:

Founder Of Greenbrier School For Girls Admits He Is Responsible For Teens Death--January 21st, 2011 (Source: huntingtonnews.net) Documents Now Show L. J Mitchell Admitted Negligence In Ryan Lewis’s Suicide “Alldredge Academy Inc, Ayne Institute and L. Jay Mitchell hereby acknowledge that they were personally responsible for the safety and well being of Ryan Lewis while he was in their care and custody and that they were personally responsible for returning Ryan Lewis safely to his parents. They hereby acknowledge that they failed in that responsibility….” Signed by L. Jay Mitchell and notarized on April 17, 2006. On February 12, 2001 fourteen year old Ryan Lewis (pictured to the left) hanged himself with a tent rope after showing an Alldredge Academy wilderness camp counselor where he had slashed his forearms with a knife. It is reported that the teen actually turned over the knife to staff and told them; "take my knife before I hurt myself more." Instead, the instructor "exacted a promise" from Ryan that he wouldn't hurt himself again and returned the knife back to the teen. Ryan, like other troubled teens, was enrolled in the 90 day wilderness philosophy program in hopes of gaining insight and help into his psychological problems and to learn about himself in a surrounding that staff members referred to as “search and rescue.” The very next day Ryan hanged himself with a tent rope. REPORTING GUIDE FOR VICTIMS, SURVIVORS, AND WHISTLEBLOWERS:
 
In West Virginia, the statute of limitations is 1 year on misdemeanors, 1 year on false imprisonment, and no statute of limitations on felonies including rape, kidnapping, human trafficking, and murder.  For civil suits in West Virginia, the statute of limitations is 2 years. 

Options for you to take action and/or seek redress/justice today are listed below:

1.  Report crimes such as assault, battery, labor trafficking, and child abuse to law enforcement in West Virginia.  You can call the Summers County Sheriff at (304) 466-7111 to inquire about filing an official complaint which may provide the probable cause needed to get a warrant for investigation and/or prosecution.  

2.  File a consumer complaint with your home state's attorney general against Greenbrier Academy and include your request for compensation for any harm done to you.  You can find the easy online forms for filing such a complaint (which may result in an investigation, prosecution, and/or civil resolution on your case) under your home state's (state where you currently reside) header at http://www.heal-online.org/report.htm.  If you are a resident of West Virginia and/or would like to file a complaint with the West Virginia Attorney General as a nonresident, please visit: https://appengine.egov.com/apps/wv/ago/consumercomplaint

All segregated congregate care providers, including those on our watch-list, are welcome to contact us to correct any information or provide additional data that may assist with delivering the whole truth to the public.  We've found in many cases where this offer has been abused or resulted in revealing additional basis for our concerns. HEAL does not support segregated congregate care for many reasons which include that many such facilities are abusive, exploitative, fraudulent, and lack effective oversight often as a result of fraudulent misrepresentation coupled with the ignorance of those seeking to enroll loved ones in such facilities, programs, schools, or centers without a valid court order and involuntarily.  In the United States such involuntary placements done without a court order are apparently illegal as they either violate the Americans with Disabilities Act community integration requirement or due process rights of those involuntarily placed.  Now, in regards to parents, in the United States parents have the right to waive their own rights, but, not the rights of their minor children.  See http://www.heal-online.org/legalarguments.htm for more information.  Now, most facilities on our watch list include waivers, indemnity clauses, and sworn statements parents must sign assuring the program that the parents have the right to make the placement involuntarily and without due process in a segregated congregate care environment, however, California and federal prosecutors as well as settled law appears to suggest that is not the case.  In fact, in the David Taylor case found at http://www.heal-online.org/provocases.htm, Taylor sued Provo Canyon School and his mother as co-defendants.  His mother was found liable for 75% of the damages awarded to Taylor as a result of multiple complaints including false imprisonment, while the program was found only 25% liable because the mother owed a duty of due diligence to investigate anyone to which she would entrust care of her child and she failed to do so. 

Now, HEAL opposes segregated congregate care and we find most placements are happening illegally in the USA which if the youth understood their rights would result in unfortunate outcomes for the parents, particularly when they don't exercise good judgment and support the fraud and abuse rather than their own children when they need remedy and justice.  And, HEAL supports all victims of fraud and abuse in seeking remedies at law for any crimes or torts committed against them.  And, that's true whether or not the program or victims are in the USA. 

HEAL has a 5 point argument against segregated congregate care we'd like you to consider:

a.  Segregated care is unconstitutional and a civil rights violation.  It is only permissible if a person is unable to survive independent of an institutional environment.  For more on this, watch the HEAL Report at  https://youtu.be/C4NzhZc4P0A.  Or, see:   http://www.ada.gov/olmstead/  which includes in part:    "United States v. Florida – 1:12-cv-60460 – (S.D. Fla.) – On April 7, 2016, the United States filed an Opposition to the State of Florida’s Motion for Partial Summary Judgment.  In the Motion, the State had asked the Court to rule, on a variety of grounds, that the United States could not recover damages for unnecessarily institutionalized children to whom the State had been deliberately indifferent."

b.  Institutionalization is always dehumanizing and coercive.  Institutionalization always harms the institutionalized and deprives them of protected civil rights.  Dr. David Straker, Psychiatry Professor at Columbia University's School of Medicine (Ivy League) explains this in detail at http://changingminds.org/disciplines/sociology/articles/institutionalization.htm.  "Many institutions, from prisons to monasteries to asylums, deliberately want to control and manage their inmates such that they conform and do not cause problems. Even in less harsh environments, many of the institutionalization methods may be found, albeit in more moderated form (although the psychological effect can be equally devastating)."  (See website linked in this paragraph for more info.)

e. Beyond the above arguments against segregated congregate care, we have reports from the NIH, Surgeon General, Yale University Studies, and much more showing the methodologies of behavior modification are damaging, harmful, and ineffective.  You can request these documents via e-mail.  In addition, for such programs offering academic services or claiming to offer diplomas, certifications, or the like, it is important to check to see if it is a diploma mill with no accredited academic services.  Please see article: "Avoiding Scams: What You Need To Know"  for important information on how to avoid education/training scams.
