Discussion and Action on Conditional Use Permit 2006-1.

Ms. Bealer stated that the City Office was notified by Chad McAllister on November 5, 2009 to have the water utilities terminated on November 6, 2009, due to Lost and Found Youth Academy relocating to Parowan, Utah. Ms. Bealer stated in the August 12, 2009 meeting it was determined that they were not incompliance with the following conditions:

1 #3 which states building design, set backs, vehicular traffic pattern or design, landscaping, lighting, signage and parking facilities will be complimentary to the intent of the general residential characteristic of the zone.

2 #4 which states all outside storage, refuse and garbage containers will be enclosed and screened from public view.

3 #6 which states site (building and grounds) will be kept clean, free of debris and consistently well maintained.

The Planning and Zoning Commission discussed that Conditional Use Permit 2006-1 has never complied with the conditions since it was issued in 2006.

MOTION: Commissioner Carter made a motion to revoke Conditional Use Permit 2006-1, Commissioner Anzalone seconded the motion, and all were in favor. The motion passed unanimously.
